California’s Pornography Laws
Under California Penal Code 311, possession of child pornography is against the law and is defined as the possession of any material that depicts a minor that is engaged in sexual conduct or simulating sexual conduct. In order to obtain a conviction of child pornography, the prosecutor must prove that you knowingly possessed the images or content in question and that you knew that these images contained minors that were under the age of 18.
Sting Operations & Child Pornography
In the Internet age, it is easy for law enforcement officials to set up sting operations for the purpose of catching sex offenders. They may set up hyperlinks and accounts encouraging you to click on films of kids having sex or view pictures of children masturbating. These links are then monitored, and if necessary, a California search warrant can be issued to search your home computer or your office.
Penalties for the Possession of Child Pornography in California
Under California law, it is a felony to possess child pornography. If you are convicted of child pornography, you face up to 3 years in state prison and up to $2500 in fines for each count of child pornography. If you have previously been convicted of child pornography, then you could face up to 6 years in state prison.
In addition to significant jail time and fines, possession of child pornography is considered a sex crime. This means that if you are convicted, you will be required to register as a sex offender for the remainder of your life.
